Explanation (English)

Writs are special orders issued by the Supreme Court (Article 32) and High Courts (Article 226) for the protection of Fundamental Rights and to ensure justice.
They act as safeguards against misuse of authority by government agencies.

There are five types of writs in India:

Types of Writs (English)

1. Habeas Corpus

• Means “To produce the body”

• Issued when a person is illegally detained and must be brought before the court

2. Mandamus

• Means “We command”

• Issued to a public officer or organization to perform a public duty

3. Prohibition

• Issued by a higher court to a lower court to stop exceeding its jurisdiction

4. Certiorari

• Means “To certify”

• Issued by a higher court to transfer a case from a lower court or cancel its illegal order

5. Quo Warranto

• Means “By what authority”

• Issued to prevent a person from holding a public office without legal authority

3. प्रोहिबिशन (Prohibition)

• उच्च न्यायालय द्वारा निचली अदालत को अधिकार क्षेत्र से बाहर जाने से रोकना

4. सर्टिओरारी (Certiorari)

• उच्च न्यायालय द्वारा मामला निचली अदालत से अपने पास मंगाना या अवैध आदेश रद्द करना

5. को-वारंटो (Quo Warranto)

• अर्थ: “किस अधिकार से”

• किसी व्यक्ति को अवैध रूप से पद धारण करने से रोकना
